Copyright and DMCA policy

Last updated: [EFFECTIVE DATE]

RingSnip respects the rights of creators and copyright owners, and we expect our users to do the same. We respond to valid notices under the U.S. Digital Millennium Copyright Act (DMCA) and similar laws elsewhere.

How RingSnip handles content

RingSnip doesn't host a library of songs or videos, and there is nothing to browse or search. Each ringtone is made on request from a link or file a user provides, and both the source audio and the finished ringtone are deleted automatically within 1 hour. When we accept a notice, we block the reported source so RingSnip won't process it again, and we act on any user responsible as described below.

1. Reporting infringement

If you believe RingSnip has been used to infringe your copyright, send a written notice to our designated agent (section 4) that includes:

  1. Your physical or electronic signature, as the copyright owner or a person authorised to act for them.
  2. A description of the copyrighted work you believe was infringed.
  3. The link (URL) of the source that was processed through RingSnip, or other information that lets us identify it.
  4. Your name, postal address, phone number and email address.
  5. A statement that you have a good-faith belief that the use isn't authorised by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act on the owner's behalf.

Incomplete notices may not be actionable. Before sending a notice, please consider whether the use could be fair use or otherwise permitted.

2. What happens next

When we receive a valid notice, we will promptly block the reported source from being processed, delete any related files we still hold, and, where we can identify one, notify the user who submitted it. We aim to act within 2 business days.

3. Counter-notices

If you believe a source was blocked by mistake or misidentification, you can send a counter-notice to our designated agent that includes:

  1. Your physical or electronic signature.
  2. The source that was blocked and where it appeared before it was blocked.
  3. A statement, under penalty of perjury, that you have a good-faith belief it was blocked by mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the United States, any judicial district in which RingSnip may be found), and that you will accept service of process from the person who sent the original notice.

We will forward the counter-notice to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they have filed a court action, we may restore access to the source.

4. Our designated agent

5. Repeat infringers

RingSnip has no user accounts, but we will block the devices, IP addresses and sources of users who repeatedly infringe copyright, when we can identify them.

6. False claims

Under U.S. law (17 U.S.C. § 512(f)), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages, including costs and attorneys' fees. If you aren't sure whether something infringes your rights, consider talking to a lawyer first.
